This note is being written to inform you (the Off Road Motorized User) and land owners in Washington State what is going on.
First if you have not heard it before YOU/ WE need to get involved.
The off road community has small pockets of supports. This is not getting the job done for us.
If you look at the other strong groups they have larger mailing list that can be activated at any moment
Why can’t we get organized are we just not interested?
I hope not because if we don’t we are not going to able to enjoy riding, driving our Off Road Vehicles on trails, roads, ORV parks and not even on our own property.
What do I mean when I say get involved?
1. Write your representative and let then know how you feel.

2. If you have time come and testify at the public hearing for the Bill on the floor.

We already missed the Public hearing on HB 1455 & SB 5089.
3. When we announce a rally in Olympia titled “ IF NOT THERE THAN WHERE ? “ Make all attempts possible to attend the
rally which is in the planning stages.
On Jan 24 a meeting was held in Olympia with
Representative Condatta (12th District Wenatchee), and
Representative Dan Kristiansen (39th District King County line to Canada line east of I-5)
The meeting Agenda was:

4. Look at a way to build a Value, Timely network to help inform “ORV USER”
and be able to ask for help when needed.

Current issue on the floor or going to be introduced:
HB 1029 companion bill SB 5031
Introduced on the floor Jan 10th this bill will make a law that you must be 17 years or older to ride a ATV over 90cc.
It also add a requirement to operate an ATV on public land a person must possess a safety certificate
Sponsors:

Requires the department to adopt standards for and implement a comprehensive all-terrain vehicle safety education and training program. The program must provide for the hands-on training of all-terrain vehicle operators, and for the issuance of all-terrain vehicle safety certificates to operators who successfully complete the training. Course content must be adopted from a curriculum developed by a nationally recognized safety organization, such as the All-Terrain Vehicle Safety Institute.
Provides that the department may authorize persons, clubs, associations, municipalities, or other political subdivisions of the state to conduct classes and issue all-terrain vehicle safety certificates in the director's name. Any authorized person, club, association, municipality, or political subdivision may charge a reasonable fee, subject to department approval, for the training course.
Requires that, beginning July 1, 2006, to operate an ATV on public land a person must possess a safety certificate issued by the director or by another state or Canadian province. A nonresident who does not possess a safety certificate may operate an ATV on public land for five days in a calendar year.
Declares that all-terrain vehicles with engine capacity of seventy cubic centimeter displacement ("cc") up to and including ninety cc may be operated on public land only by those aged twelve years and older.
Declares that all-terrain vehicles with engine capacity greater than ninety cc may be operated on public land only by those aged sixteen years and older.
Requires persons under age sixteen to be under continuous adult supervision while operating an ATV on public land.

SB 5099 companion bill Unknown Title: Modifying motor vehicle emission standards. (This may affect the Off-Road Community as well as on road)
SB 5099 - DIGEST
Provides that, on or before December 31, 2005, the department shall adopt rules, in accordance with the
provisions of chapter 34.05 RCW, to implement the light duty motor vehicle emission standards of the state of
California, and shall amend these rules from time to time, in accordance with changes in emission standards
in California. These regulations shall be applicable to motor vehicles with a model year 2009 and later.
Provides that, after adoption of rules specified in this act, no vehicle shall be registered in the state for
model year 2009 or later unless the vehicle: (1) Is consistent with the vehicle emission standards adopted by
the department of ecology; or
(2) Has seven thousand five hundred miles or more.
Repeals 1991 c 199 s 229 (uncodified).

SB Unknown companion bill HB1003 Title: Allowing off-road vehicles on no highway roads
HB 1003 - DIGEST
Finds that the limited amount of ORV recreation areas presents a challenge for ORV recreational users,
natural resource land managers, and private landowners.
Finds that local, state, and federal jurisdictions should be given the flexibility to allow ORV use on
nonhighway roads they own and manage or for which they are authorized to allow public ORV use under an
easement granted by the owner.
Declares that it is lawful to operate an off-road vehicle upon a nonhighway road and in parking areas serving
designated off-road vehicle areas when the responsible governing body, including state, federal, or local
authorities, authorizes the use of off-road vehicles.
Provides that an off-road vehicle operated on a nonhighway road under this section is exempt from licensing
requirements of RCW 46.16.010 and vehicle lighting and equipment requirements of chapter 46.37 RCW.
Current issue on the:
SB 5089 companion bill HB1455 Title: Limiting nuisance noise from off-road vehicles
This Bill makes it so you can not ride or operate an ORV with in 600 feet of your property line. It also has ORV vehicles must meet new sound muffling standards to 96db

HB 1455 - DIGEST
Limits use on lands zoned as residential within six hundred feet of another property owner's residence, or within six hundred feet of another property owner's barn, stable, penned area, or similar structure or confined area occupied by any livestock, as defined by RCW 16.36.005, in a repetitive manner or on a track for purposes of recreation or practicing for races, jumps, tests, or similar purposes.
Provides that a person who is guilty of violating this provision is subject on the first offense to a fine of not less than one hundred dollars. On each subsequent violation, the person is subject to twice the amount of fine as on the last infraction.
Misappropriation of NOVA FUNDS
Current issue that is going to be introduced:
Here is one not introduces into the Senate yet from Senator Fraser (Thurston County Senator)
Senator Fraser has written a letter to IAC and Thurston County telling of her deviously deeds
Senator Frazer wants to appropriation funds from the NOVA in the amount of 1,600,000,to used for the Department of Community, Trade and Economic Development –County Assistance“
Senator Fraser is the Senate budget house leader.
So Thurston County closed their ORV Park. Members of Thurston County now have no place to ride. So they ride on their property. Now members of the Senate & House want to tell us (Washington Residents) we can not ride on our property. Thurston County was served with a lawsuit of 1.6 million dollars. Thurston County has a contract with IAC on major improvements grants. The contract stated if you close the ORV Park you will have to pay back the money or open a Like facility. Thurston County has asked for a jury trial. And Senator Fraser is doing every thing she can (unethical as it is) to bail out Thurston County because of the two county commissioner we sit in office and are incompetent to hold such an office.

Look at a way to build a Value, Timely network to help inform
“ORV USER” and be able to ask for help when needed.
In a effort to support this large task ahead we are looking for “KEY” members of different originations that are willing to be “Communication Focal” responsibility would be to:
1. Review with other focal the importance of items to be distributed.
(What is meant by this is only important information not Flyers for a clubs event. The focal would proof read come to a consensus of what is being sent out.
2. Distribute all information approved to their (Club, Dealership, users) Data Base byways of e-mail or postage if needed.
3. We will need to come up with a common title so every knows that the message being sent is of importance example would be “Washington Outdoor Users Unite” or “Washington Outdoor Users” Will be determined at a follow on meeting
4. The Communication Focal would also help come up/ monitor events from their interest groups that may need to be sent out asking for help or just important information.

5. Look at the value of a Rally in Olympia in March
Right now we are in the planning stages of a Rally to Olympia. We are looking at introducing a bill the would do a study on ORV growth in Washington and the need for ORV sports Park for the users of ORV.
If we can have something in the House or Senate and we are able to get an organized Rally we would use the “Communication Focal” to Send out information.
Our Logo would be “If Not Here than where” This also will be determined at a follow on meeting.
Hope to see more members support the effort of us few.
